Terms & Conditions

These ‘Terms and Conditions’ form a contract between ‘Through the Lens Photography’ and the ‘Client’, acceptance of which is agreed from the moment the ‘Client’ signs the ‘Photography Contract’.

 

  1. Entire agreement

This agreement constitutes the entire agreement between the parties and supersedes all previous agreements (written or oral) between the parties in relation to its subject-matter.

Each party acknowledges that in entering into this agreement it has not relied on, and shall have no right or remedy in respect of, any statement, representation, assurance or warranty (whether made negligently or innocently) other than as expressly set out in this agreement.

Nothing in this clause shall limit or exclude any liability for fraud.

 

  1. A Summary of the Contract

The photographer is responsible for providing for the client a photographic service and products as detailed in section 3 (‘coverage’) of the Photography Contact.

 

  1. Payment Arrangements

The client agrees to pay Through the Lens Photography the agreed upon fee and deposit set out in section 4 of the Photography Contract.

The client understands and agrees that the deposit, which is paid on execution of the Photography contract, is non-refundable or transferrable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation.

The client understands and agrees that the balance is to be paid no later than 60 days prior to the event date.

Cancellation less than 90 days before the date of the wedding will require payment in full. All cancellations must be in writing. The cancellation conditions above will apply for postponed weddings if the photographer is not able to re-schedule for the new date and time. The fee for postponed weddings is subject to change.

Any additional payments for albums and other services are to be made when that order is placed. Prices for orders placed over one year after the date of the wedding may be subject to change. This included orders included in the initial wedding package.

 

  1. Copyright

The copyright and all other rights in the Photos shall be retained by Through the Lens Photography and Events (the “Photographer”). The Photographer asserts the right to be credited as the author of the Photos in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. Any unauthorised reproduction of any Photos will constitute a breach of copyright, at all times throughout the world.

Where a disc of photographs (digital image files) has been provided to the bride and groom as part of their wedding collection, these photographs may be printed, and displayed online, for personal but not commercial use.

The photographer retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting his work or any other use.

 

  1. Crowd release

In accordance with the General Data Protection Regulation (GDPR) by signing this contract, Clients are agreeing to and ensuring guests of events are aware of the following:

By entering and by their presence at the event, they consent to be photographed, filmed and/or otherwise recorded.  Entry constitutes consent to such photography, filming and/or recording, the photographer retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting his/her work or any other use of your appearance, voice and name for any purpose whatsoever relating to the event you are attending.  The client understands that all photography, filming and/or recording will be done in reliance on this consent given by you by entering this area.  If you do not agree to the foregoing, please do not enter this area.

 

  1. Insurance

Clients are advised to take out an appropriate insurance policy if they are booking the Photo Services for an event.

 

  1. Severability

If any provision of this contract is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of this contract shall remain in full force and effect.

 

  1. Authority

This shall be governed by and construed in accordance with English law, and each party agrees to submit to the exclusive authority of the courts of England and Wales.
